1. Agreement to Terms
By accessing or using SPNT's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.
2. Description of Services
SPNT DOO provides security audit, offensive security testing, infrastructure hardening, and compliance management services through our Serpentine platform products: Odbrana, Napad, Postava, and Regulativa.
3. Account Registration
To use certain features, you must register for an account. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
4. Acceptable Use
You agree not to:
- Use our services to scan or attack systems you do not own or have explicit authorization to test
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use our services for any illegal purpose or in violation of any laws
- Interfere with or disrupt the integrity or performance of our services
- Reverse engineer, decompile, or disassemble our software
- Resell or redistribute our services without authorization
5. Authorization for Security Testing
By using Serpentine's security scanning and testing services, you represent and warrant that:
- You own the assets being scanned or have explicit written authorization from the owner
- Your use complies with all applicable laws and regulations
- You will not use results to exploit vulnerabilities in unauthorized systems
6. Payment Terms
For paid services, you agree to pay all applicable fees. Fees are non-refundable except as required by law or as expressly stated in these terms. We may change our fees with 30 days' notice.
7. Intellectual Property
Our services, including all software, content, and documentation, are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our services without our written consent.
You retain all rights to your data. By using our services, you grant us a limited license to process your data as necessary to provide the services.
8. Disclaimers
Our services are provided "as is" without warranty of any kind. We do not guarantee that our services will identify all security vulnerabilities or that your systems will be secure after using our services.
Security testing inherently carries risks. While we take precautions to minimize impact, you acknowledge that testing may affect system performance or availability.
9. Limitation of Liability
To the maximum extent permitted by law, SPNT shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.
Our total liability for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify and hold SPNT harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.
11. Termination
We may suspend or terminate your access to our services at any time for any reason, including violation of these terms. Upon termination, your right to use the services will immediately cease.
12. Governing Law
These terms are governed by the laws of North Macedonia. Any disputes shall be resolved in the courts of Skopje, North Macedonia, except where mandatory consumer protection laws apply.
13. Changes to Terms
We may modify these terms at any time. We will notify you of material changes via email or through our services. Continued use after changes constitutes acceptance.
